General

The business relationship between TSCHIDA TSCHILI and the customer is governed exclusively by the following General Terms and Conditions (GTC) in the version valid at the time the order is placed. TSCHIDA TSCHILI reserves the right to amend these GTC at any time and without stating reasons. By placing an order, the customer accepts the GTC valid at that time.

Shipping Costs

Shipping is carried out exclusively with DPD.

The shipping costs for Austria and Germany can be found during the ordering process. The thresholds for free shipping are also shown there.

We are happy to accommodate special requests.

Contract & Withdrawal

In the event of printing, typing or calculation errors on the website, TSCHIDA TSCHILI is entitled to withdraw from the contract. If, contrary to expectations, a product is unavailable for reasons beyond the control of TSCHIDA TSCHILI, TSCHIDA TSCHILI is entitled to withdraw from the purchase contract. The customer will be informed as quickly as possible if the ordered goods are unavailable.

You place an order in our shop by:

  1. Adding items to the shopping cart
  2. Entering your billing and/or delivery address
  3. Selecting a payment method
  4. Reading and accepting the GTC
  5. Submitting the order

Conclusion of the Contract

You submit a binding offer once you have completed the online ordering process, entered the required information, clicked the “Complete Purchase” button in the final step and accepted the General Terms and Conditions.

After you have submitted your order, we will send you an email confirming that we have received your order and listing its details (confirmation of receipt). This confirmation of receipt does not constitute acceptance of your offer; it merely informs you that your order has been received by us.

You will receive all customer information from us no later than upon delivery of the goods. Your orders are stored by us. If you lose your order documents, please contact us by email or telephone. We will be happy to send you a copy of your order.

Prices

All prices stated in EUR (euros) include the applicable VAT. Upon publication of new prices, all previous prices cease to be valid. In the case of limited-time offers, the applicable validity period will be stated.

5. Delivery

Your order will be dispatched from our warehouse by the fastest available parcel delivery service selected by TSCHIDA TSCHILI. Orders are generally dispatched after receipt of the order to the delivery address provided by the customer.

Our standard delivery times are assigned to the respective destination countries and are shown during the ordering process. Any exceptions can be found on the respective product page.

If delivery is delayed because an item is temporarily out of stock at TSCHIDA TSCHILI, we will inform the customer as quickly as possible.

Shipping is available to Austria and Germany and may also be possible to other countries. Delivery to P.O. box addresses is not possible.

By placing an order, you agree to the processing of your shipment by our shipping partners. Our current shipping partner is DPD. The General Terms and Conditions and other conditions of the respective shipping service providers must also be observed and can be viewed on their websites.

Tracking information is sent exclusively by digital means to the email address provided when placing the order. The information sent regarding your delivery, in particular information concerning delivery attempts and parcels deposited at so-called pick-up shops, must be taken into account.

If a parcel is not collected despite shipping updates and collection reminders being sent by email, a further shipment can only be made upon payment of additional costs equal to the original shipping costs. Any costs incurred due to parcels being returned by the shipping provider because they were not collected, including shipping and return shipping costs, will be deducted in the event of an order cancellation.

If the recipient grants permission for a parcel to be left at a designated location, the associated risks, in particular loss and damage, pass to the recipient in accordance with the shipping provider’s terms and conditions and cannot be transferred to or claimed against TSCHIDA TSCHILI.

Payment & Ownership of property

Payment is only possible using the payment methods offered. Cash payment is, of course, possible for orders collected in person.

The delivered goods remain our property until payment has been made in full.

Contact, Complaints & Contact Person

The customer expressly agrees to electronic communication by email.

If there is a defect for which TSCHIDA TSCHILI is responsible, the customer may request subsequent performance and may choose either rectification of the defect or delivery of a defect-free item. TSCHIDA TSCHILI may refuse the chosen form of subsequent performance if it would result in disproportionate costs.

The customer is requested to have any obvious transport damage confirmed in writing by the parcel delivery service immediately upon receipt of the shipment. Such damage must be documented with meaningful photographs, in particular photographs of the outer packaging.

Notifications of defects and complaints may be submitted exclusively by email. We always strive to find a suitable solution for our customers.

We expressly point out that payment disputes or chargebacks initiated through payment service providers, such as PayPal, Stripe, etc., without a prior complaint by email and without allowing TSCHIDA TSCHILI to process the complaint, will not be accepted. Any fees incurred as a result of payment disputes will be charged to the party responsible. The amount of such fees is determined by the respective payment service provider and can also be viewed there.

The complaint procedure by email must be followed.

TSCHIDA TSCHILI is not liable for damages unless such damage was caused intentionally or through gross negligence by TSCHIDA TSCHILI.

TSCHIDA TSCHILI undertakes, without the customer’s prior consent, to collect or use personal data only to the extent necessary to establish, where applicable amend, and perform the contractual relationship and to enable further communication with the customer.

TSCHIDA TSCHILI exercises the utmost care and applies the level of security required in business practice in order to protect your personal data against unauthorised access.

Special Conditions for the Sale of Plants

These special conditions apply in addition to the other provisions, in particular the section on delivery.

Shipping of plants generally begins in mid-April. Due to system-related limitations of the IT infrastructure, the stated standard delivery time only applies from mid-April onwards. This restriction applies only until plant shipping begins and only to plants.

For combined orders containing both plants and other products, all ordered goods will be shipped together at the earliest possible time. For orders placed before mid-April, the other products will therefore also only be dispatched once plant shipping begins.

Varietal Purity

Despite the greatest possible care and documentation, we cannot provide a 100% guarantee of varietal purity. Our quality management system reduces the risk of receiving a different variety to a minimum. In the event of any discrepancy, please inform us by email.

All plants exhibit phenotypic growth characteristics. The different growth habits may vary considerably. The stated plant size refers not only to the height of the plant but also to its width. At the time of dispatch, the plants are fully suitable for annual cultivation.

It is normal for individual leaves to break off during shipping. As these are living plants, this does not constitute grounds for a complaint provided that only individual leaves are affected. A side shoot will usually develop where a leaf has broken off. If the extent of the damage is excessive, please submit a complaint by email together with photographs for documentation.

Electronic Data Processing for Contract Performance

Data submitted by customers is processed electronically without further verification. The provisions of the “Privacy Policy” section remain unaffected.

This may result in errors, particularly in invoicing, shipping processing including shipment tracking, and payment records. TSCHIDA TSCHILI is not liable for costs or delays resulting from errors in the data provided.

Applicable Law

Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
